EU Rules on packaging sizes for Spirits

The European Union regulates the packaging of prepacked goods through Directive 2007/45/EC of the European Parliament and Council, adopted on 5 September 2007. This directive sets out uniform packaging sizes for different product groups such as wine, aromatized wines, and spirits to promote fair competition, safeguard consumers, and ensure transparency across the internal market.

Standard bottle sizes for Spirits in the EU

Under this directive, spirits can only be sold in the EU in a specific set of nominal quantities:

100 ml – 200 ml – 350 ml – 500 ml – 700 ml – 1,000 ml – 1,500 ml – 1,750 ml – 2,000 ml

From this list, it is clear that the standard bottle size for spirits in Europe is 700 ml, not 750 ml. While 750 ml bottles are widely used in other regions especially in North America they are not authorized within the EU.

The 750 ml Compliance Problem

Despite the rules, some producers outside Europe and importers bringing products into the EU still use the 750 ml format. Although acceptable in markets like the United States and Canada, these bottles do not meet EU requirements.

Spanish customs authorities have recently highlighted this issue when intercepting shipments containing 750 ml bottles of spirits. Since EU law applies across all Member States, the restriction is not limited to Spain but is enforced Union-wide.

Who is Responsible?

The duty to comply rests with producers, importers, and distributors. Any business placing spirits on the EU market must ensure its packaging matches the approved sizes. Selling bottles in non-standard formats such as 750 ml can lead to:

  • Customs delays or confiscation of goods
  • Financial penalties
  • Damage to reputation

How businesses can stay compliant?

To avoid problems, companies should:

  1. Communicate clearly – Inform distributors and clients that the official EU standard size is 700 ml.
  2. Adapt packaging strategies – Ensure bottles intended for the EU market meet the requirements of Directive 2007/45/EC.
  3. Avoid customs complications – Using the correct formats helps prevent shipment delays, disputes, and penalties.

Final Note

Directive 2007/45/EC leaves no room for exceptions: only the listed sizes are legal within the EU market. For spirits, that means 700 ml is the standard, while 750 ml bottles are not permitted. It is therefore essential for producers and sellers to adapt their packaging to avoid regulatory and customs issues.
